Essay Instructions: Dispute Resolution Essay

Read the following paragraph:
Sue and Tom are business partners. They have a partnership in which they purchase and renovate homes and apartment buildings. They have worked together as partners for five years and currently own seven properties. A few months ago they talked about purchasing another property. Sue was in favor of the purchase but Tom was not sure because he believed the asking price was too high. Tom told Sue he would let her know his decision by a specific date. On the date that he was suppose to give his answer he was out-of-town on vacation. Two days later Sue purchased the property in her name. When Tom returned, he told Sue he thought the partnership should buy the property. Sue told Tom she had bought the property in her name alone. Tom asked Sue to put the property in joint name so the partnership could own it. Sue refused.

Write an Essay of approximately 1500 words and include the following:
Your opinion as to whether Tom should proceed with a lawsuit.
A discussion of whether arbitration might be a better possibility.
A discussion of whether mediation might be effective.

Decide the type of dispute resolution Tom should pursue. Explain why your choice best fits the facts as presented. Also, discuss why you have NOT selected the other two types of dispute resolution.

Essay Instructions: The objective of this assignment is to demonstrate an understanding of the effects of the use of alternative dispute resolution (ADR) to supplement court trial processes, with particular focus on its impact on caseflow management. For at least the last 20 years, most state and local jurisdictions have begun institutionalizing ADR programs and procedures for a variety of case types. In many situations, this has been the result of statutory changes, but with or without legislative action, court rules have been implemented in states across the United States to address how the addition of ADR processes can supplement and sometimes replace court dispute resolution.

Find a jurisdiction where state or county statutes require an ADR process in some or all types of divorce cases prior to proceeding with a divorce case in the courts. Discuss how the addition of ADR processes has affected caseflow management in general, and in divorce cases specifically. (The Steelman, et al. publication for NCSC, Caseflow Management: The Heart of Court Management in the New Millennium, is an excellent resource.)

In your essay, respond to at least the following questions:

Why have so many jurisdictions turned to forms of ADR to supplement the judicial process?

What are the major effects on caseflow management of the decision by jurisdictions to insert ADR requirements into divorce case processing?

What are the short-term and long-term costs and benefits, including dollar costs/benefits and social costs/benefits?

Use references within the past five years to keep it current.

My Religious theory approach life
My faith is very important to me. Ever since I was a child, I have always wanted to serve God by tending to His flock. I grew up in a Catholic school where we were thought about God’s love for humanity, the value of life and the joys of serving other people especially those who are in need. I grew up to be an active member of our church. My family encouraged me to participate in church activities and lead a life of service to my fellow human beings. The teachings of the Church have left a very positive impression in me and as I grew older, I find myself leaning towards the Church even closer.
I believe that I should be compassionate towards people of other faiths and recognize them as suffering beings first, before seeing them as people of other faiths. Second, I believe I should learn as much as possible from the doctrine and practice of other faiths as a cultivation of my own faith.

About my memoir
I am working on a memoir called Life Soup: Memoirs of a Culinary School Dropout that is different that other because the happy ending is that the experience leads the Walter Mitty type of reader into the circuitous, yet familiar world of attempting to reinvent oneself and fulfill one's dreams by being fired from the office cubicle and jetting off somewhere to make the dream happen because there is now nothing else to lose. Unlike many memoirs, it helps Walter live with and come to grip with failure in the real and less exciting world.
In the memoir, I have not just left my unfulfilling job in corporate America, but have been fired from it as well. This makes my dropping out from culinary school doubly crushing and disappointing. I was one of the more than 50 percent of culinary school students that end up dropping out of the course due to the demanding nature of the training. I just did not have the motivation to succeed after being balled out by the French instructor.
The book will begin with my getting fired from a well paid CPA position in a fortune 500 company in the recession in 2008. The second section will be the arrival at culinary boot camp and trying to fit in. The fourth will constitute my realization that disaster and failure was coming and the resulting crushing failure itself. The recovery and road to reinvention after reinvention is a cliffhanger and will keep the reader on the edge of their seat until the end of the last part of the book.
